¢ñ. General description for system of state-owned land use in China
In Article 9 of ¡°Land Management Law¡±, the provision is laid down ¡°The use-right of state-owned and collective-owned lands can be granted to a unit or individual according to law¡±. Therefore, domestic and overseas legal persons, unincorporated organization and natural person all can obtain the use-right of state-owned land according to law.
In Article 2, Section 5 of ¡°Land Management Law¡±, the provision is laid down ¡°The State implements the system of compensated use of state-owned land according to law, but except for that of administrative allotment within limit of the legal provisions¡±. From this alone, the basic ways to get use-right of state-owned land in China are by means of compensated use and administrative allotment.
